Terms and Conditions

1. GENERAL

Prior to any commercial transaction, the client or the client’s agency (hereinafter referred to as the “Client/Agency”) agrees to subscribe in full to the terms and conditions set forth in the General Sales Conditions of Amo Travel. These general sales conditions are an integral part of all contracts, whether verbal or written, between Amo Travel and the Client/Agency.

2. SERVICES

The services provided by Amo Travel include the creation of travel programs that are either predetermined and accepted by the client, or built in consultation with the client, taking into account the latter’s specific needs.

Amo Travel hereby commits to providing the client with all services specifically listed in the travel program established by mutual agreement. Amo Travel is prepared to provide, if necessary, services related to specific client requests—such as obtaining a visa to enter Vietnam or logistical preparations not included in the program—subject, where applicable, to an additional fee.

3. PRICE VALIDITY

All prices indicated for AVN products are in US Dollars ($US) or Euros (€), as previously stated. These prices are valid for the entire duration specified in the receipt or any other document delivered to the Client/Agency by AVN. AVN guarantees the validity of prices, receipts, or documents provided to the Client/Agency at the time of distribution; however, price lists may be subject to adjustment in cases of force majeure (significant currency fluctuations, sudden government tax increases, etc.).

Publication Validity This information is valid at the time of publication but is subject to change without notice. In the event of a change, updates will be posted on the website immediately. However, if the Terms and Conditions change after the deposit has been paid, the terms and conditions in effect at the time of the deposit payment shall apply.

4. RESERVATION AND CONFIRMATION

All reservations are made through AVN or a sales agency designated by AVN. Immediately upon confirmation of the booking, a deposit of 30% of the total tour cost must be paid, and the remaining balance shall be settled upon arrival in Vietnam or, at the latest, at the start of the tour. Otherwise, Amo Travel reserves the right to cancel the trip and retain the full deposit already paid by the Client/Agency. Any refund (minus administrative fees in accordance with the cancellation policy) will be valid for one (01) year from the date the deposit was received. During this period (365 days), the amount may be applied to other trips and services. After one (01) year, the deposit amount is forfeited.

For legitimate reasons (floods, sudden interruption of airline services, civil unrest, etc.) or other cases of force majeure, AVN reserves the right to change or modify the Client/Agency’s itinerary, with or without prior notice.

5. DEPOSIT

Amo Travel accepts the following payment methods:

Upon receipt of the deposit, a receipt and booking confirmation will be sent via fax or email. Note: The prices confirmed by AVN for the provided services do not include bank fees. Therefore, the Client/Agency is responsible for these transaction charges.

  1. Credit Card Payment

Amo Travel accepts both online and offline credit card payments for your convenience.

  • Online Credit Card Payment: Payments via OnePAY (Visa, MasterCard, American Express, and JCB accepted) will incur a 3.85% service transaction fee.
  • AVN connects securely with the OnePAY Payment Gateway (https://onepay.vn). All card information is processed via SSL protocol in compliance with international card security standards. Card data will not be stored on our system (Merchant).
  1. Cash

Cash payments can be made at the Amo Travel office or directly to the operators. Unlike other methods, cash payments are not subject to any commission or service fees.

6. PAYMENT OF TOUR BALANCE

Unless otherwise specified by Amo Travel, the client must settle the remaining balance of the tour at the beginning of the trip. However, the client may choose to settle the balance prior to the start of the journey if desired.

In the event of failure to fulfill the payment obligation within the aforementioned conditions, the booking will be considered canceled by the client, and the provisions set forth in Section 7 shall apply.

7. AMENDMENTS

Flexibility is AVN’s strength. You can modify your booking even after it has been made. Simply contact your travel consultant or reach out to us at sales@amovietnam.com with your booking number. Our reservations team will be happy to adjust your booking with your preferred alternatives.

a. Modifications by the Client

The client may request a modification of the booking at any time, subject to the payment of any expenses incurred by Amo Travel due to such changes. Amo Travel is committed to addressing these requests with the utmost diligence, subject to the availability of the requested services.

  • A postponement of arrival is considered a modification.
  • Reducing the number of participants is not considered a modification. Instead, it will result in the application of cancellation penalties for the withdrawing participants and a reassessment of rates for the remaining participants.

b. Modifications by Amo Travel

Amo Travel reserves the right to modify the services included in the final travel program in the following cases:

  • Force Majeure: The amendment is justified due to an event of force majeure. In this case, the change may result in additional costs to be borne by the client or covered by Amo Travel.
  • Safety and Quality: The amendment is necessary to ensure the safety and/or quality of the client’s trip. In such cases, any additional costs incurred shall be borne by Amo Travel.

8. CANCELLATION AND REFUND

I. Cancellation by the Client / Agency:

In the event that the Client / Agency decides to cancel the booking, regardless of the reason, the Client / Agency agrees to pay a cancellation penalty as follows:

These rules apply to all services reserved by Amo Travel for the Client/Agency. The refund of the deposit (minus applicable cancellation fees) to the Client/Agency will be made via bank transfer. The Client/Agency remains responsible for any service charges applied by banking institutions during the fund transfer.

II. Cancellation by Amo Travel

Amo Travel reserves the right to cancel the trip, in whole or in part, in the event of force majeure. These are unpredictable, unpreventable, and unavoidable events that make travel impossible or dangerous for the client, such as war or threat of war, riots, natural or nuclear disasters, port blockades, looting, fires, terrorist activities, severe weather, epidemics, quarantines, or any similar event.

In all cases of cancellation, Amo Travel will refund the Client/Agency a portion of the tour cost (if applicable), net of additional costs related to itinerary changes, penalties charged by hotels, airlines, or any other service providers, and bank fees. The Client/Agency shall not be entitled to further compensation.

9. CLIENT OBLIGATIONS / INSURANCE

a. Client Responsibility

Before embarking on the journey, it is the client’s responsibility to ensure they meet all requirements regarding:

  • Passport: Minimum validity of six months after the return date, with at least two blank pages.
  • Health: Physical fitness, required vaccinations, and preventive treatments.
  • Visa: Mandatory for Vietnam, Laos, and Cambodia (unless exempt). Amo Travel can, upon request, assist the client in the visa application process.

b. Insurance

Amo Travel is an inbound travel agency and does not provide personal insurance, travel insurance, or assistance services. We strongly recommend that you purchase comprehensive insurance in your home country before arriving in Vietnam. However, Amo Travel will act as a local intermediary between you and your insurance company should the situation require it. Please provide your insurance policy details for use in case of emergency.

Anyone participating in a trip organized by Amo Travel must take out an insurance policy covering international travel, medical expenses, and repatriation at a minimum. This insurance is typically offered by travel agents or airlines at the time of international flight purchase. The insurer’s details and policy number must be communicated to Amo Travel before the trip begins.

During the trip, the traveler must follow the rules announced by the guide or any other Amo Travel representative. These rules are designed to ensure client safety and the quality of the travel program.

Amo Travel commits to providing all necessary on-site assistance to the client in the event of an insured accident, particularly in assisting with administrative formalities with local authorities and the insurer.

10. EXEMPTIONS AND LIMITATIONS OF LIABILITY

Amo Travel commits to providing the Client/Agency with all services specified in the sales contract. Throughout the duration of the tour, the Client/Agency must comply with the rules announced by the guide and the service providers.

Amo Travel acts as an intermediary between the Client/Agency and the relevant airlines, hotels, transport operators, and local tourism offices providing the services. Therefore, Amo Travel is not liable for any losses, injuries, or damages sustained by the traveler, including those occurring outside the tour program. Additional expenses incurred due to delays, accidents, natural disasters, political actions, or unrest shall be borne by the traveler.

The client is responsible for all of their actions: any activity that falls outside the travel program or any violations of the law in the visited country are not the responsibility of Amo Travel. Any cancellation of travel plans due to legal issues deprives the client of any right to a refund from Amo Travel.

Amo Travel is responsible to the client as an intermediary between the latter and various service providers (airlines, hotels, restaurants, boat operators, etc.) and, as such, ensures a certain quality of service; however, Amo Travel cannot be held liable for the specific actions of these providers, who maintain their own independent liability.

Amo Travel shall in no case be held liable for events resulting from force majeure. In such instances, the Client/Agency may be refunded (where applicable) but is not entitled to any further form of compensation or indemnity.

11. UNUSED SERVICES

No refunds or exchanges will be made for accommodation, meals, guided tours, transport, or any other services included in the tour price that are not utilized by the tour members.

However, if the trip is interrupted during the tour due to the client’s health, Amo Travel commits to doing its utmost to secure alternative services or provide a partial refund for the cancelled services.

12. COMPLAINTS AND DISPUTE RESOLUTION

Any complaint regarding the performance of any service included in the program must be submitted in writing to Amo Travel within a maximum period of 30 days from the end of the trip.

Most issues can be resolved quickly if Amo Travel is made aware of them; therefore, any dispute between the client and Amo Travel must be prioritized through amicable negotiation.

In the event that Amo Travel decides to make compensatory payments to a client, these shall not, under any circumstances, exceed the cost of the travel services provided by Amo Travel (excluding international airfare). This applies only if the entire course of the trip was compromised and the client derived no satisfaction from the services. In all other cases, Amo Travel reserves the right to offer compensation at its sole discretion.

If an amicable solution cannot be reached, the courts of the state where the contract is executed shall have jurisdiction. In the event of a formal dispute or complaint, the “Vietnam International Arbitration Centre” (VIAC), a branch of the “Vietnam Chamber of Commerce and Industry” (VCCI), shall be the sole competent authority for resolution.
